These general terms and conditions apply to all Agreements, for any product or service Responsiv offers, and should be read with signed Agreement and such other Terms and Conditions referenced in the Agreement, together which will make the full extent of the contractual agreement by the parties.

Responsiv provide our own products, and resell IBM products according to the terms of the “Responsiv Software Product Licence”. Please download and understand these terms if you are procuring software products, for example Responsiv Unity Modules or Extenders, for self-hosting or as hosted solutions.

Responsiv provides a Cloud Solutions Agreement which governs use and access to the Solution.
Responsiv provide Solutions as a Service, Platform as a Service, and Software as a Service in the form of specific services or as part of an assembly of components. The terms of the “Responsiv Software Hosting Licence” are applicable in all cases. Responsiv provide hosted services on ResponsivCloud.co.uk and hosted solutions backed against Microsoft Azure and IBM Cloud platforms depending on customer need.
Data Protection
Your data is important irrespective of where they are located, which is why we have implemented GDPR controls as our baseline standard for all our operations worldwide. GDPR has taken effect from 25th May 2018.
GDPR is an EU-wide privacy and data protection regulation that controls how personal data about EU residents is protected by companies and enhances the control the EU residents have over that data. The regulations are relevant to any globally operating company and not just the EU-based businesses and EU residents.
What is personal data?
Any data that relates to an identifiable or identified individual. GDPR covers a broad spectrum of information that could be used on its own, or in combination with other pieces of information, to identify a person. Personal data extends beyond a person’s name or email address. Some examples include financial information, political opinions, genetic data, biometric data, IP addresses, physical address, sexual orientation, and ethnicity.
How does Responsiv conform to GDPR?
We have acted on many fronts to adhere to this new regulation, including having a register of systems and processes that work with personal data, streamlining processes to avoid excessive steps, and removing old data. We have also established new relationships and data sharing agreements with our partners, and controls to protect our own staff.

This Data Processing Addendum (DPA) is referred to by Responsiv Product Descriptions for Products hosted and operated by Responsiv.
The technical and organisational measures provided in this DSPP apply to Responsiv Services (including any Components) only where Responsiv has expressly agreed to comply with the DSPP in a written contract between Responsiv and Customer. For clarity, those measures do not apply where Customer is responsible for security and privacy or as specified below or in a Responsiv Services Document.
